Sotwell of Catlinghill

Pre-nuptial settlement : 20 Apr 1495
Henry Sotehill, brother to John Solehill of Everyngham, esq., and Elizabeth, his wife, late wife of Laurence Sekilbrice, sister and heir to Sir Anthony Nuttall, knight, of the first part, and Robert Barnby and John Barnby, his son and heir, of the second part.
On the marriage of John Barnby and Agnes, one of the daughters and heirs of Laurence Sekilbrice and Elizabeth.
Reciting that Sir Anthony Nuttall was atteynt of treason in the parliament held in 1461/2, and by reason of this, all manors and lands which he had were seized by the King, and conveyed to George, Duke of Clarence. The parties of the first part agree that they shall convey to the parties of the second part, within 6 weeks, the chief mansion house of Nuttell, and all lands and tenements belonging to the manor of Nuttell, to the yearly value of 10 marks, after the lands have been taken from the Duke of Clarence, and to the use of the parties of the first part.
In return, the parties of the second part agree to pay to the parties of the first part, half dele of the money that shall be paid to the Duke, and half dele of the charges likely to be incurred.
The parties of the first part further agree to enfeoffe William Copley of Doncaster, John Villers of Fullaby, Nicholas Sotehill of Everygham, Alexander Drax of Woodhall, Henry Rokley of Ledes and William Symmes of Wirksburgh, in and of lands to the yearly value of £10, part of the above mentioned lands; so that the feoffees shall reserve rents and profits of the lands to specified uses. John Sotwell sen. of Cathill, par. Silkstone, Yorkshire, clerk and William Sotwell of Greenham, Berkshire, gent. son and heir of John Sotwell, of the first part, and Richard Sotwell of Cathill, Silkstone, Yorks., gent., second son of John Sotwell, and brother of William, of the second part.
On the marriage of Richard Sotwell and Alice.
The parties agree as follows, that party (1) is to be seized of a farmhold messuage in Cathill and Hoylandswayne, viz, one house newly built, where John Sotwell the elder lives; one house called Ellis House, in Cathill; moity of all houses belonging to John Sotwell and Margaret, his wife; moity of a fold belonging to John Sotwell: 1 garden; 1 orchard; one little croft called Ellis Croft; close called the Inge; close called the Heald; close called Awtor Royd; close called the Pingle; close called the Vewe Close; close called Hollin Close, all premises being in Cathill and Hoylandswain, and now in the tenure of John Sotwell, the elder.
To the use of John Sotwell for life, and then a moity of the above properties, to the use of Richard Sotwell and Alice his wife for life, and then to the use of their heirs. For default of this line, to the use of John Sotwell junior, and Edward Sotwell and their heirs; the other moity to the use of Richard Sotwell and his heirs, then to John Sotwell junior, Edward Sotwell, and their heirs.

Confirmation of marriage settlement. 22 Mar 1608
John Sotwell of Cathill, Yorks., clerk, confirms that, under the terms of the marriage settlement of 4 Aug 1603, on the marriage of Richard, his second son, and Alice, he has enfeoffed to John Hepworth of Cumberworth, Yorks., yeoman, and John Micklethwait, jun., of Ingbirchworth, Yorks., yeoman, all his capital messuage in Hoylandswayne (fully described in SpSt/147/20).

  1. annunity of £20 to wife Elizabeth, to be payable out of his messuage at Cathill and a close called the Great Royds in Thurlston
  2. to wife Elizabeth, various furnishings in the parlour and chamber over the parlour, and she is to have the use of these rooms for life.
  3. to eldest son, John, £20, in lieu of his child's portion.
  4. to eldest daughter, Mary Dawson, one shilling.
  5. to Richard Sotwell, his son, £100.
  6. to William Sotwell, his son, £150.
  7. to Edward Sotwell, his son, messuages and lands at Cathill and Thurlston
